He has acted for clients in both ad hoc as well as institutional arbitration under the ICC, LCIA, HKIAC, ICSID, SIAC and UNCITRAL Rules. He has represented companies in the banking and finance, construction, energy, infrastructure, mining, technology and telecom sector, before judicial forums in India and institutional and ad hoc arbitral tribunals.

Besides arbitrations, Abhileen has acted for clients in commercial and white collar crime litigation, and bankruptcy matters and has represented them before various judicial forums. Beyond commercial dispute representation, Abhileen has advised clients on contractual claims, BITs executed by the Government of India and dispute resolution procedures before arbitration tribunals. Arbitration

  • Represented a UAE incorporated corporation in two London seated arbitrations under the ICC Rules in disputes arising out of a contract for manufacture of equipment for a refinery in India.
  • Represented the subsidiary of a multinational construction company in an ICC arbitration seated in Paris. Disputes arose under a joint venture agreement for the construction of housing projects in India.
  • Worked on an LCIA arbitration seated in London arising out of disputes between board members of a large construction company in India.
  • Represented a mine developer and operator in a domestic ad hoc arbitration against a public-sector company relating to cancellation of coal block allocations in India.
  • Represented an Indian solar energy company in an ICC arbitration seated in Geneva over disputes under an equipment purchase agreement and corporate guarantee executed by the promoter company.
  • Represented a Canadian construction company in an ad hoc arbitration against an Indian entity. Disputes arose under a contract for construction of a bauxite treatment plant in Andhra Pradesh.

Litigation

  • Represented Resolution Professionals during the Corporate Insolvency Resolution Process under the Insolvency & Bankruptcy Code, 2016. The Resolution Professionals were appointed for companies in the maritime, engineering and metals/metallurgical sector.
  • Represented a Norwegian entity in a lawsuit filed against it by a builder for recovery of tax (MVAT) dues at the Bombay High Court.
  • Represented a corporation and its board members in criminal proceedings arising out of default in repayment of credit facilities availed from banks and financial institutions.
  • Represented a logistics company in winding up petitions, civil suits, and arbitrations after lenders sent recall notices for credit facilities advanced to the company.

Advisory

  • Advised an investor in the sports sector on invocation of investment arbitration proceedings against India under the India – Mauritius BIT.
  • Advised an investor in the telecom sector on proposed investment arbitration against India under the India – Malaysia BIT.
  • Drafted opinions for an Indian manufacturer, concerning its contracts with a European company after issues arose due to the sanctions imposed by the European Union after declaration of war between Russia-Ukraine.
  • Advised the international trade department of a foreign State on the dispute resolution clause in the proposed FTA with India.
